The primary accountability of the CSC is to ensure that residents/property owners conform to the POA Covenants & ASC Standards. In doing so, when a non-conforming “violation” has occurred, a three-step process of notification follows a fair and systematic process of informing and working with property owners to rectify these situations:
1. A "first letter” is provided to the property owner. (On occasions a committee member may orally communicate this). The specific instance of non-compliance is stated with reference to the Covenants. The notified date is specified along with a due date by which to rectify the non-conforming situation. Any questions will be attempted to be answered by the CSC personnel.
2. A “second letter” is provided to property owner if one fails to satisfactorily rectify the non-compliance by the due date. This 2nd letter then communicates a date for the property owner to appear before the CSC for a “show cause” hearing, wherein a property owner is provided an opportunity to present his case for cause or failure to comply.
A “third letter” is provided immediately following a “show cause” hearing, which provides notice of the findings and decision of the CSC. If it is determined that there is not sufficient merit to allow the continuation of a non-compliance situation; then the CSC can levy a $/per/day fine attached to the property to begin on a specific day until the non-compliance is properly corrected. The property owner has the right of appeal to the POA Board in writing with-in 15 days.
Proper adherence to our Covenants and ASC Standards is part of living in and maintaining our beautiful community and not a difficult task for willing property owners. Our CSC members, as neighbors, seek your cooperation in helping us do our job. The best days that we enjoy are any days without non-compliance notification. |
